The Richmond Police have reportedly received the missing Police Department flash drive from a 3rd party (neither Mo Karnage of the Wingnut nor Nathan Cox of Copblock).  See link above for full news report.

The flash drive was reportedly found on the ground near a trashcan. The cop Martin Harrison who’s flash drive it was had testified in court that he never took the flash drive from police headquarters- yet said there were no reported intruders during the few days when the flash drive went missing. And yet the flash drive was found outside.

You might remember from a couple of years ago that the Wingnut Anarchist Collective and the Richmond Police Department had a tiff regarding some files from the RPD’s General Orders that the Wingnut got a hold of using the Freedom of Information Act (FOIA). More about that here (

And after the police were forced to drop their case before it even hit the courts, they refused to comply to any FOIA requests coming from members of the Wingnut Anarchist Collective. We didn’t have the legal resources to take them to court over their violation of the FOIA laws. Instead we made multiple online asks for the info if anyone else already had a copy or was able to get one. (

Well, someone finally came through, and an anonymous source gave people access to the rest of the General Orders from the RPD, as well as some other files. Since these files regard the rules the police must follow, and since tax money goes to pay for the police, we figure this is public information, and we are re-posting links to it here. We hope it finds you well and helps you protect yourself and your legal rights.

Richmond Copwatcher and member of the Wingnut Anarchist Collective, Mo Karn, was detained, arrested, and ticketed in May while Copwatching for standing on the sidewalk of Barton Avenue.

The arraignment was on May 31st, and a court date was set for July 31st.

Please come out to support Mo and Richmond Copwatch, and to stand up to bully cops, on July 31st at 11am in Judge Cheeks’ court room at 920 Hull St in the Manchester Court Building.

You can’t bring cell phones, weapons, food, etc., but you CAN bring a sketchpad and pencil to draw and record the court proceedings. We ask that you do so.

A group of us were on the porch of the Wingnut when we saw a RPD cruiser stop to pull over a young man of color who was walking down Barton Avenue. They stopped him with the excuse that he was walking in the street, but this was a very clear use of racial profiling and “stop and frisk” type policing. We grabbed our Copwatch video camera, and walked down the block to film the incident. We did not have the camera recording our full approach, and were unable to get video of the police frisking the man, though some of us did witness it.

One officer, M Godwin, was fairly aggressive about not allowing Copwatcher Mo to stand on the public sidewalk. A car pulled up Home St. while the RPD cops had their cruiser parked in the middle of Barton Avenue, completely obstructing the road. The folks in the car asked very politely if the police could move the cruiser so they could get by, since Barton is a one way street and they couldn’t turn the other way. The police ignored them.

When the police were done harassing our neighbor, they drove off. We started to head back to the house, when someone noticed they had gone down a few blocks and stopped another young man of color. We did not witness the initial stop, so can’t say for sure what excuse they used for detaining him while they ran his ID.

The person they detained said this was the 3rd time he has been randomly stopped by the cops this week. If you listen carefully you can hear him say this in the video. The amount of police and police harassment in Southern Barton Heights is why we started Copwatch 2 years ago. Unfortunately the cops still engage in racial profiling, harassment, brutality, and many other behaviors which hurt the community.

Again, we approached the scene to film and observe. Both times we were not asked to leave the scene, or even to step back from the scene. During the second incident, Officer Godwin again approached Mo and told her that she couldn’t stand on the sidewalk. He did not say anything about people standing on the grass just as close, or anything about his scene, officer safety etc. He was very clearly just trying to harass Mo.

At one point Mo tried to walk past the RPD Cops who were very clearly blocking the sidewalk. The cops stopped Mo and refused to let her go by. Later, a woman and a child walked up the sidewalk, easily past Mo who was allegedly obstructing the sidewalk, and through the scene without a problem.

Officer Godwin told Mo to move off of the sidewalk repeatedly. Mo told him repeatedly that she was legally allowed to be on the public sidewalk. He eventually demanded Mo’s ID and stomped off to write a citation. Officer Godwin was not stopping anyone from standing in the grass next to the sidewalk, or just as close to the scene as Mo was. After he wrote Mo the citation she walked back to where they had been standing before on the sidewalk. (The young man the RPD had detained was STILL at this point being held by the police, so there was more copwatching to do).

Officer Godwin then threatened to give Mo 5 seconds to get off the sidewalk or else he would take Mo to lockup. However, when Mo answered a phone call he walked off.

Mo’s summons says it is for violation of Law Section 18.2-404 102.2 and the charge is described as “Obstructing Free Passage”. This is a criminal charge- a first degree misdemeanor.

Mo’s court date is Thursday May 31st at 9am at the Manchester general district court at 920 Hull St. on Richmond’s southside. Supporters are encouraged to come out on the 31st to support Mo, and Richmond Copwatch, as well as the right of people to stand on the sidewalk.

The May Day Parade this year was a success, involving the longest route yet, and no police harassment or arrests.

We took the whole street up Main street, up Harrison street, and down Broad Street from Harrison to 6th. There were impressive contingents of queer bees, and a focus on immigration as well.

Thanks to the All Saints Puppets, the speakers, bike marshalls, and legal observers for helping to make the parade a success.

UPDATE: Since for whatever reason the story about the Wingnut/Richmond Copwatch using FOIA to get files from the Richmond Police Department is hot now on the internet, we are reposting this request for help.

The police refuse to send us these files.
We are asking for your help.

We are also interested in any and all government documents you might have pertaining to Virginia, Virginia police (and protocols), FBI and Virginia activist organizations and anarchists etc.

Richmond Copwatch has had an ongoing FOIA request with the Richmond Police Department since January. We were requesting the 2nd half of the documents of police protocols that we did not get the first time we made a request. Since that time the Richmond Police Department has violated the Virginia Freedom of Information Act numerous times. They have a 200 dollar deposit from us, and they are also saying that so far the costs are over 900 dollars. Their lack of communication and compliance make it clear that they are giving us the run around.

We clearly have reason to believe that the police department is refusing to follow the law with this FOIA request because of who we are. We have filed a complaint in court, but VA FOIA law is very limited in its ability to hold government agencies accountable, even if they wanted to.

Since it is taking so long, we were wondering if anyone out there had already used FOIA to get these files. The list of titles we are interested in are below. If you have the time, it would also be awesome if people wanted to submit their own FOIA requests to the Richmond Police Department for these files. However, we would love to take a look at any files people have FOIA’d from the Richmond Police Department. If you have them online, please email them to wingnut_collective@yahoo.com or you can mail a hard copy to Richmond Copwatch 2005 Barton Avenue Richmond, VA 23222 If you have a copy of any of these files that we can borrow that would be great so we can copy and scan them.

Check out this movie our friend put a lot of work into! Keep in mind that not everyone in this film is still a Wingnut resident, or necessarily supportive of all Wingnut projects. Clearly a 20 minute film can’t capture the complexities of our lives. Things aren’t always sunshine and roses. But we hope that everyone in this movie is doing awesome anarchist things and having a great time doing them!

IWW Food & Retail Workers United

On behalf of Fellow Worker Moriah “Mo” Karn, the Richmond General Membership Branch of the Industrial Workers of the World and IU640 (Restaurant, Hotel, & Building Service Workers Industrial Union) are initiating a campaign to demand that $183.18 in unpaid wages be paid in full to fellow worker Karn.

Fellow worker Karn worked as a bartender and waitstaff for 3rd St. Diner located at 218 E. Main St. in Richmond, Virginia. Fellow worker Karn has yet to receive any compensation for their labor after working a total of 86 hours at a wage of $2.13 an hour, between November 3rd and November 22nd, 2011.

Although in the state of Virginia, it is a violation of law to withhold a final paycheck from an employee after removal (see §40.1-29 Va State Code); the Virginia Department of Labor and Industry was of little help.  When fellow worker Karn filed a complaint with the Virginia Department of Labor, they were told that because there was no written proof of their hours worked, ie. a time sheet, schedule, etc., and because the employer failed to process her W2 form, there was nothing the Department of Labor could do for her.

In lieu of this news we, on Friday April 6, 2012 a letter was issued to owner, Mr. William “Billy” Polyaris requesting that fellow worker Karn be paid in full by 4:00pm Friday April 12, 2012, or further action would follow.  We received no response.

Whereas the inability of the state to procure justice for workers who are victims of wage theft, and whereas Mr. Polyaris appears to have no issue with exploiting workers, we call upon supporters to participate in a phone blast, putting pressure on management, demanding retribution for Karn and her fellow workers.

Some Facts About Tipped-Employees’ 

The Federal Minimum Wage was last raised in 2009 from $6.55 an hour to $7.25 an hour in July, 2009. Some states (not Virginia) have raised the minimum wage,  however there hasn’t been any legislation to raise the Federal Minimum Wage for tipped employee’s since 1991.

Originally, the federal tipped worker minimum wage was 60% of the full minimum wage.  However, it was frozen at just $2.13 per hour in 1991.  Because it has not been increased at all in the decades since then, it has plummeted in value to less than 30% of the minimum wage.(1)

Many states provide stronger protections for tipped workers by requiring that tipped workers be paid above the federal rate.  Illinois guarantees tipped workers 60% of the minimum wage.  In New York and Connecticut it’s approximately 70%.  And Alaska, California, Minnesota, Montana, Nevada, Oregon and Washington guarantee tipped workers the full minimum wage – a best practice that has successfully reduced poverty among tipped workers in those states.(2) Why can’t Virginia become one of those states?

According to the National Restaurant Association, 1 in 10 working Americans nationally work in restaurants which collectively register sales exceeding $600 billion.  Virginia restaurants employ over 342,200 people, and were projected to register $12.8 billion in sales.  Restaurant jobs represent 9% of employment in Virginia.
